Article 1. Definition terms

a) The social network service provider (hereinafter referred to as “Provider”) is Tien Binh Pho Company Limited, established and operating legally under the provisions of Vietnamese law.

b) The social network system is the technical platform and infrastructure to provide services to Users of social network services on the social network page of Tien Binh Pho Company Limited.

c) Social network service users (hereinafter referred to as “Users”) are individuals who own legal social network accounts to use social network services on the Supplier’s website. It is stipulated that, based on the review and consideration of the Content Moderation Department, User’s posts are or are not allowed to be posted on the Supplier’s social network site, based on the assessment that the content of the post must be consistent with the scope of information exchanged by the Supplier on the social network site; and must comply with the provisions of this Agreement and the law.

d) Personal information is information associated with identifying the User's identity, which the User agrees to provide to create a login account for the Supplier's social networking system according to the registration form on the social networking site.

d) Private information is information that Users provide on social networks in a non-public form or publicly available only to one or a group of Users whose specific personal information has been identified.

e) Public information is information on social networks that is made public by the Provider or User for all other users to know without identifying specific personal information of those Users.

f) The Social Network Management Board is a department under the Supplier, responsible for managing the operation of the social network site; resolving violations, complaints from Users and other related issues in the process of managing the operation of the social network site.

g) The content censorship department is a department under the Supplier, responsible for checking and approving the content of articles and information provided by Users to post on social networks; at the same time, supporting the Social Network Administration Board to detect and handle violations during the operation of the social network site.

Article 2. Scope of content exchanged, shared and provided on social networks

Users are free to exchange, share, and provide information in the fields of technology and science serving or related to the products and services of Tien Binh Pho Company Limited, except for the following prohibited contents for exchange and sharing on social networks:

a) Content that opposes the Socialist Republic of Vietnam, harms national security and social order and safety; sabotages national unity; propagates war and terrorism; causes hatred and conflicts between nations, ethnicities and religions.

b) Content that propagates and incites violence, obscenity, depravity, crime, social evils, superstition, and destroys the nation's fine traditions and customs.

c) Content related to state secrets, military secrets, security, economy, foreign affairs and other secrets as prescribed by law.

d) Information that distorts, slanders, or insults the reputation of an organization or the honor and dignity of an individual.

e) Content of advertising, propaganda, sale of prohibited goods and services, dissemination of prohibited press, literary, artistic works and publications.

f) Fake information, false information that infringes upon the legitimate rights and interests of organizations and individuals.

g) Information that is illegal, fraudulent, defamatory, insulting, obscene, offensive, threatening, abusive, hateful, provocative... or contrary to the general ethical standards of society.

h) Content that meticulously describes obscene acts, violence, gruesome murders; offensive images, lacking humanity, not suitable to Vietnamese customs and traditions.

i) Content that propagates advertising messages, invitations, promotion of investment opportunities or any form of communication that is not within the scope of information exchange and sharing on social networks to serve the interests of any other individual or organization.

k) Information containing viruses or components that are harmful to the social network system, computers, the internet and confidential information of the Supplier and/or other Users on the social network.

l) Information that infringes copyright according to the provisions of the current Intellectual Property Law.

Article 3. Rights and obligations of users of social networking services

1. Rights of Users of social networking services:

a) Users have the right to be instructed in the use of tools and features for creating information content, sharing information and using utility services on social networks.

b) Users have the right to contribute opinions to the Provider during the use of social network services. Suggestions are sent directly by letter or email to the Social Network Administration Board (information of the Social Network Administration Board is mentioned in point d, clause 1, Article 7 of this Agreement).

c) Users have the right to protect the confidentiality of personal information, private information and other relevant information according to the provisions of this Agreement and the provisions of law.

d) Users have the right to post articles and comments on social networks through the censorship of the Content Censorship Department, to ensure that the information content provided by the User falls within the scope of information provided. exchange permission as prescribed in Article 2 of this Agreement and the provisions of law.

2. Meaning Social network service users' services:

a) Before using social network services, including but not limited to using services or tools on the Provider's website, the User must register for a social network account and be responsible for All activities are performed under the registered account name and password.

b) When registering a social network account, the User must be 14 (fourteen) years old or older. In case the User is under 14 (fourteen) years old and does not have an identity card or citizen identification card or passport, when registering a social network account, the User must ensure that he or she has the consent of the user. Legal guardians and legal guardians are responsible first
Law on registration of users' social network accounts. Without the consent of the legal guardian, the Provider has the right to not allow the User to register a social network account.

c) Users must ensure that the personal information being used and provided to the Provider is up-to-date, truthful, complete, and accurate according to the instructions in the registration form to use social networking services. Supplier Association. At the same time, the User must always maintain and promptly update registration data to ensure that this data is latest, complete, honest and accurate.

d) Users are responsible for protecting their own passwords on social networks. The supplier encourages users to use highly secure passwords (including lowercase letters, uppercase letters, numbers and symbols, and ensure the length of the password according to the supplier's regulations). to ensure optimal safety).

Users are solely responsible for the content and images of comments and articles posted on social networks, as well as the entire transaction process with partners on social networks during use. social network service.

f) The user agrees not to reproduce, copy, sell, resell or exploit for commercial purposes any services, content (in articles, comments) of the social network (including including the User's personal account) or on behalf of any third party without written permission from the Provider.

g) Users must notify the Social Network Administration Board when their account and password are accessed illegally. The Supplier does not bear any responsibility, directly or indirectly, for any damage or loss caused by the User's failure to notify in accordance with the provisions of this agreement.

h) Users are responsible for cooperating and providing appropriate information when requested by competent state agencies to serve investigation activities, or statistical work, or other appropriate tasks. other as prescribed by law.

i) Users must comply with the provisions of law on sharing and exchanging information, protecting intellectual property rights, protecting consumer rights and other relevant provisions of law when using the product. use social network services.

j) Users commit not to use social networking services for commercial, illegal, fraudulent, threatening or destructive purposes; create and spread viruses that damage the system and social network configuration; transmit information on social networks or use social network services for the purpose of speculation, manipulation, or division of the market. In case of violation, the User must be responsible for his or her actions before the law.

k) The user commits not to change, edit, copy, propagate, distribute, provide and create similar tools of social network content and services provided to third parties. three without the Supplier's consent in each specific case.

l) Users must not act to discredit the Supplier in any form, such as posting information (including comments and articles) that compares or disparages competitors. compete directly with the Supplier or content that offends the honor and dignity of any other individual or organization, affecting the Supplier's business activities.

m) Users are not allowed to arbitrarily lock passwords or illegally use passwords and private information of other users on social networks.

n) Users are not allowed to infringe, access or use any part of the social network server. Any act of taking advantage of system errors for personal gain causing damage to the Supplier is strictly prohibited.

Article 4. Rights and obligations of Social Network Service Providers

1. Rights of Social Network Service Provider:

a) For social network systems:

i. The Provider reserves the right to add, modify or remove any interface, presentation, component or function, content of the social networking site at any time without prior notice.

ii. The Provider reserves the right to add, change or delete any content in this Agreement without prior notice. By continuing to use the social network service after such changes or additions, the User implicitly agrees to comply with the amended or supplemented content of this Agreement.

iii. The Provider reserves the right not to guarantee, or warrant that any part of the social network content will be uninterrupted, error-free, virus-free, punctual, safe, accurate, stable or of any other nature. Which content is safe for users?

iv. The Provider has the right to develop service policies applicable to each appropriate subject on the social network. These policies will be published on the social network at each time according to the decision of the Social Network Management Board.

b) For users of social networking services:

i. The Provider has the right to request the User to provide necessary personal information to use the social network service, and to receive service fees applicable on the social network depending on the Provider's regulations and policies at each time, based on relevant regulations of Vietnamese law.

ii. The Provider has the right to disclose any content that the User posts on social networks, including the User's personal information if the User agrees or is required by law or competent state agencies to provide or for the purpose of research and improving the quality of the Provider's social network services.

iii. The Provider has the sole right to remove comments, posts of Users or deny User access to the social networking site or any part of the social network immediately without prior notice if The Supplier discovers that the User has violated any provisions of this agreement.

iv. The Provider reserves the right not to endorse any matter, incident or event and for any purpose, corresponding to any person, product or service of a third party.

v. The Provider reserves the right to refuse to publish, remove or block access to any content that a user has provided on the social network at any time, for any reason, with or without notice.

vi. The Provider has the right to check and process the information posted by the User to comply with good customs, ethical rules, national security rules and regulations in this Agreement and the law. Accordingly, the Provider has the full right to allow or not allow the User's posts and comments to appear on social networks.

vii. If the User does not comply with the Provider's regulations, the Provider has the right to block the User's right to comment or post and/or refuse or stop providing social networking services depending on the User's discretion. the Supplier's review and the level of violation of the conduct.

2. Obligations of Social Network Service Providers

a) The supplier must provide social network services in accordance with the content and objectives set out in this agreement.

b) Supplier must establish and maintain measures to protect the confidentiality of personal and private information of Users; Inform users of their rights, responsibilities and risks when storing, exchanging and sharing information on social networks.

c) Suppliers must ensure users' right to decide when allowing their personal and private information to be provided to other organizations and individuals.

d) Suppliers are not allowed to proactively provide public information with content that violates the provisions of Article 2 of this Agreement.

e) Supplier must coordinate with competent state management agencies to remove or prevent information that violates the provisions of Article 2 of this Agreement upon request.

f) Suppliers must provide personal information and other relevant information of Users related to terrorist activities, crimes, and violations of law when requested by relevant state management agencies. authorization.

g) The Supplier must commit to ensuring at least 01 server system located in Vietnam to meet the requirements of inspection, examination, storage, and provision of information at the request of competent state management agencies and to resolve complaints from Users regarding the provision of services according to regulations of the Ministry of Information and Communications.

h) Suppliers are responsible for reporting according to regulations and are subject to inspection and examination by competent state management agencies.

Article 5. Handling mechanism for Users who violate the Agreement on provision and use of social networks

1. Principles for handling violations:

When the Social Network Administration Board discovers that a User has committed an act that violates the provisions of this Agreement, it is stipulated that, based on the Social Network Administration Board's review and consideration of the extent of damage caused by Violations committed by Users against the Social Network System and the rights of other Users or other related entities as stipulated in this Agreement, the Social Network Administration Board will decide. corresponding form of handling violations.

2. Violation handling process:

Step 1: The Social Network Administration sends a notice to remind the User about the violation by text message or email or regular mail or notification on the social network (At most, each violation can only be reminded remind 01 (one) time); The reminder content includes a request to stop the violation or request to correct or amend the violation information in accordance with the provisions of this Agreement.

Step 2: In case the User repeats the violation, depending on the severity of the violation, the Social Network Administration Board will decide to block the right to comment, the right to post articles or delete the user's social network account. permanently without prior notice.

Note: In case the User commits an act that violates the law or violates the provisions of the Agreement, seriously affecting the operation of the social network system as well as the rights of other related subjects. , The Social Network Administration Board will decide to delete and block the User's social network account immediately from the first time the violation is detected; At the same time, bring the case to the state management agency for handling according to the provisions of law of the Socialist Republic of Vietnam. 

Article 6. Warning about risks when storing, exchanging and sharing information on social networks

a) The Provider allows Users to post, store, send or receive content (from posts or comments), including images and clips on social networks. However, the Provider does not guarantee that the information uploaded, stored or shared by Users on social networks is accurate, safe and does not contain information security risks.

b) On the social network website, there may appear links to other websites or icons of other websites, these websites may not be under the control or ownership of the Provider. Accessing these other pages may be risky and dangerous. The User is fully responsible for the risks when using this linked website. The Provider will not be responsible for the content of any website or destination that the User has accessed, used the link, the link displayed on the social network.

c) Users must ensure that the content posted on social networks does not violate Vietnamese and international intellectual property laws. Using social network services does not mean that Users have the copyright to use the content that users access. Users may not use content that is not theirs on social networks without obtaining permission from the legal owner or performing other procedures as prescribed by law.

Article 7. Methods of resolving complaints and disputes

1. Mechanism for resolving complaints and disputes

a) Any dispute arising during the User's use of social networking services will be resolved in accordance with the conditions in this Agreement and the current provisions of law of the Socialist Republic of Vietnam. Vietnamese meaning.

b) The supplier only supports and resolves complaints from users in cases where the user has entered complete, truthful and accurate information when registering an account.

c) All disputes on social networks will be resolved in the spirit of negotiation and conciliation by arranging for the parties to meet and discuss directly, or according to any other conciliation measures chosen by the parties. selected through written consent.

d) Any complaints arising during the use of services on social networks will be sent to the Social Network Administration Board according to the following information:

Immediately after an event giving rise to a complaint occurs, the Social Network Management Board will base on each specific case to have an appropriate resolution plan.

e) In case negotiation or conciliation measures do not achieve the desired results, one of the parties is free to choose to bring the case to the competent People's Court of Vietnam for resolution according to regulations. of Vietnamese law.

2. Procedure for reviewing and resolving complaints and disputes:

a) The Social Network Administration Board receives complaints from users;

b) The Social Network Administration Board transfers complaint information to the department responsible for resolution;

c) Within 30 working days from the date of receiving the User's complaint, the Social Network Administration Board will reply to the User about the results of resolving the complaint, and at the same time assist the parties in resolving the complaint. Resolve disputes for each specific case.

d) Complaints and disputes that cannot be resolved through negotiation or conciliation will be conducted at a competent Court according to the proceedings prescribed by Vietnamese law.

Article 8. Policy on collecting and processing personal information of users of social networking services

a) The Supplier guarantees that all personal information collected on the social networking website is based on the User's login and declaration.

b) Information collected on social networks will be used widely across all social network services that the Provider is providing to Users, and will be used for all purposes on social networks, to ensure optimization of features and effectiveness of the information used.

c) The Supplier will store personal information posted by Users on the Supplier's internal systems during the process of providing services to Users or until the purpose of collection is completed.

d) The Supplier shall not disclose, share, rent, or sell the User's personal information or private information to other organizations or individuals for any purpose unless the User agrees or the Supplier receives a request to provide information from competent state agencies.

Article 9. Information security policy of users of social networking services

a) The Supplier makes every effort to protect the User's personal information and private information from unauthorized access. However, the Supplier does not guarantee and does not undertake to prevent all unauthorized access, intrusion, or use of personal information beyond the Supplier's control. Therefore, the Supplier will not be responsible in any form for any claims, disputes or damages arising from or related to unauthorized access, intrusion, or use of information beyond the above control.

b) The Supplier implements measures to protect the User's personal information by:

i. Limit personal access information;

ii. Use technology products to prevent unauthorized computer access;

iii. Delete the User's personal information when the information is no longer necessary for the purpose of storing social network records.

iv. If the User believes that his/her security has been violated or intruded upon due to the lack of security assurance on the social network's security system, the User can contact the Social Network Administration to report and resolve the issue.

c) The Provider has the full right to proactively edit the information security policy on social networks at any time when necessary, or as prescribed by law, to ensure the optimal operation of the social network, and to ensure that the obligation to respect the law is always absolutely enforced. All content of the information security policy, and amendments and supplements to this policy will always be updated and published on social networks, and will be dated and updated so that Service Users can recognize the latest content.

Article 10. Privacy policy

a) Users have the right to keep confidential and the right to decide to disclose their information including personal information, private information and other relevant information provided and exchanged on social networks; at the same time, the above information of the User will be protected by the Supplier from illegal and unauthorized access, seizure and control of the User, except in cases where there is a request from a competent state agency.

b) Only Users have the right to access (including creating, viewing, editing, deleting) and control personal information, private information and other relevant information that Users provide, share and exchange on social networks; at the same time, have the right to decide which subjects are allowed to search, view, share and exchange their above information on social networks.

c) In case the User registers to use a third party service on a social network, the User agrees to provide personal information, private information and other relevant information to a third party and is responsible for the confidentiality of the information provided. The Provider is not obliged to ensure the safety and privacy of the User's personal information in this case.

Article 11. Modification and discontinuation of services on social networking sites

a) The Provider continuously changes and improves the quality of the social network service for the User. Therefore, the Provider may, with or without notice, modify or discontinue the service to the User at any time. The User agrees that the Provider has no obligation of any kind to the User or any third party for the modification, suspension or discontinuation of the service on the social network.

b) The Provider may, in each specific case and without prior notice, immediately terminate the terms and conditions established under this agreement and terminate the User's right to use the social networking service. The reasons for such termination include but are not limited to: a violation or anticipated violation of the agreement or other applicable government or law guidelines; upon request by law enforcement or other competent authorities; discontinuation or fundamental changes to the social networking service; unexpected technical or security problems; account inactivity for a long period of time; the Provider has reasonable grounds to believe that the User is using or intending to use the social networking service to engage in fraudulent or illegal activities; the User fails to pay any service fees that the User is required to pay…

Article 12. Amendment of agreement

The Supplier may (but is not obligated to) amend the content of the agreement when deemed necessary and in accordance with the law at any time; and provide Users with notices, including notices of changes related to the Agreement via email, regular mail or posting on social networks. The User agrees that such notices by electronic or regular mail, and the display of notices and links to notices to the User on social networks shall be deemed sufficient notice.

Article 13. Limitation and Exclusion of Liability

a) The Provider affirms that the posting of content and sharing of information on social networks is entirely based on the User's personal will and views. The Provider creates an environment for Users to communicate and share information with each other but is not responsible for any incorrect or inaccurate information in the content posted by the User.

b) The Provider is not responsible for the consequences directly or indirectly related to what the User does on the social network. The User is responsible for evaluating and accepting all risks associated with the use of any content in the article or comment including the accuracy, completeness, or usefulness of this content.

c) In the event of a dispute arising from the User's actions, content or information on the social network, the User agrees to hold the Provider and its parent companies, subsidiaries, affiliates and related companies, affiliated organizations, officers, representatives, partners, suppliers, employees of the social network, harmless from any claims, including reasonable attorneys' fees, made by any third party.

d) Service users are fully responsible for all information, images, and video clips posted on social networks. The provider is not responsible for any violations of the law in the posted content, or violations of copyright or intellectual property rights related to the content and images posted on social networks.

Users who commit violations must compensate and reimburse the Supplier for all losses and expenses (including attorney and court costs, if any) that the Supplier may have incurred. bear the consequences and disputes arising from any violation caused by the acts or errors of that service user.

e) If any complaint or dispute arises between the User and the copyright owner regarding the content posted on the social network, the User must proactively resolve and negotiate with the relevant copyright owner, and be solely responsible for resolving the complaint, and must be responsible for paying for any damages arising from copyright, trademark, and intellectual property infringement, to ensure that the Supplier's business operations are not affected.

Article 14. Applicable terms

This Agreement is effective from the date the User agrees to use the social network service of Tien Binh Pho Company Limited by completing the registration of a social network account; serves as the basis for binding the User's responsibility to the Supplier; stipulates the conditions that the User must comply with, and will be applied to all individuals, organizations, and businesses using services on social networks.

Article 15. Terms of commitment

Tien Binh Pho Company Limited and organizations, individuals and businesses using services provided on social networks commit to comply with the regulations and terms of this agreement.

Any violation of this agreement will be responsible before Tien Binh Pho Company Limited and Vietnamese law.
